A living will is similar to a testamentary will in that it allows you to set out your wishes but it is different because it takes effect during your lifetime whereas a testamentary will only becomes effective after you have died.

A living will is also called an advanced directive. It is a legally binding document which sets out your wishes regarding the provision of care and medical treatment. You cannot use a living will to demand treatment, you can only set out what treatment you would like and what treatment you would like to refuse.

Living wills are commonly created by the elderly and those going into hospital for medical treatment anyone can have an advanced directive. The most common reason for creation is for the client to set out their wishes to refuse life-sustaining treatment such as blood transfusions and resuscitation. The document could also be used to set out your choice of care home or hospital or who should be contacted in the event of an emergency, should you be unable to communicate your choice at a later date.
