Lasting Power of Attorney Property and Financial Affairs
Preparing a lasting power of attorney property and financial affairs will allow you to appoint somebody you trust to look after your property and financial affairs if you are unable to do so. Unlike the general power of attorney a lasting power of attorney property and financial affairs is suitable if you are becoming mentally ill as the document will remain effective even if you are no longer able to understand that the power is being operated, so long as the document is registered with the Court of Protection.
A lasting power of attorney property and financial affairs is not usually created for a set period of time, it is usually indefinite but can be restricted by the provision of usage clauses. Once created and registered the power will not automatically come to an end unless you or your attorney(s) die, your attorney(s) disclaim their appointment, a marriage or civil partnership between you and your attorney is dissolved or annulled or you effect a deed of revocation.
Clients who usually create a lasting power of attorney property and financial affairs typically do so because they want the security of knowing that if they are unable or unwilling to manage their property and affairs their attorneys will take over.
You can appoint anyone who is over the age of 18 and has the mental capacity required as your attorney. They could be family, friends, your professional advisor or a mixture but you must trust the person or people you appoint to deal with your finances and property.
The lasting power of attorney property and financial affairs gives your chosen attorney or attorneys the power to make decisions and take actions on your behalf. The attorney(s) effectively steps into your shoes and his/her actions will be treated as if they were made by you. Granting an unrestricted, unspecific lasting power of attorney property and affairs you will allow your attorney to administer all of your property and financial affairs. This could include buying or selling property, shares, personal possessions and business assets etc. An attorney appointed under a lasting power of attorney property and affairs cannot effect decisions on your health and welfare.
A lasting power of attorney property and financial affairs must be registered with the court of protection to be effective. This process involves the completion of registration requirements and payment of the courts registration fee.
